This Booking Policy sets out the terms and conditions for commissioning drone photography and videography services from Dan Conway Photography. By booking my services, you (the client) agree to the following terms. These terms are designed to ensure clarity, safety, and professionalism in all commissioned work.

1. Deposits & Payments

A 40% non-refundable deposit is required to confirm and secure all bookings. This deposit must be paid by direct bank transfer to the official business account of Dan Conway Photography.

The remaining balance must be paid in the same way, upon receipt of my invoice, and no later than 7 days after project completion unless otherwise agreed in writing.

Services, including delivery of final images or video, will not be released until full payment has been received. Late payments may incur additional charges.

2. Weather Conditions

Drone operations are highly dependent on weather. For safety and legal compliance, I cannot operate drones in rain, high winds, or adverse weather conditions. If a booking must be rescheduled due to poor weather, I will work with the client to arrange an alternative date. Deposits are retained and transferred to the rescheduled session.

3. Flight Restriction Zones (FRZ) & No-Fly Zones

Drone operations are restricted in certain areas, including Flight Restriction Zones (FRZ) and other no-fly zones. I handle all paperwork, applications, and authorisations necessary to conduct flights legally. However, any authorisation permit fees are the responsibility of the client. These fees must be paid in advance, and the booking must be made with sufficient notice (minimum 14 working days) to process authorisations.

4. Advance Notice

Due to regulatory and planning requirements, all drone commissions must be booked with adequate notice. A minimum of 14 working days is required before the intended shoot date. Short-notice bookings may not be possible if legal clearances cannot be obtained in time.

5. Travel Fees

A travel fee applies to all projects: - £10 for locations within Lancashire & Greater Manchester - £20 for the rest of Great Britain (excludes Northern Ireland)

These costs will be added to the final invoice unless otherwise agreed in writing.

6. Copyright & Usage Rights

All commissioned drone footage and photography remain the copyright of Dan Conway Photography unless otherwise agreed in writing. Usage rights (personal, editorial, or commercial) will be explicitly outlined in the client’s contract or invoice. Clients are not permitted to alter, resell, or distribute the work without prior written consent.

7. Delivery of Work

Final edited images and/or video will be delivered digitally within 5 working days of project completion, unless otherwise agreed in writing. Delivery will be made via secure digital transfer or private online gallery.

8. Non-Disclosure Agreements (NDAs)

I am comfortable working under a Non-Disclosure Agreement (NDA). If an NDA is required, it is the responsibility of the client to draft, provide, and facilitate this agreement prior to the commencement of work.

9. Licensing & Compliance

All drone operations are carried out in compliance with Civil Aviation Authority (CAA) regulations and current UK drone laws. I will not conduct any activity that breaches legal or safety requirements. The safety of people, property, and airspace always takes priority over client requests.

10. Insurance

Dan Conway Photography is fully insured for commercial drone operations, including public liability cover. This insurance does not extend to negligence on the part of the client, unsafe locations, or failure to disclose hazards.

11. Cancellations & Rescheduling

- Cancellations made more than 7 days before the scheduled shoot will result in the deposit being retained but no further payment required. - Cancellations made within 7 days of the shoot will incur an additional fee of 25% of the total agreed cost. - In the event of cancellation due to adverse weather or regulatory restrictions beyond our control, deposits will be carried forward to a rescheduled date.

12. Client Responsibilities

The client is responsible for ensuring that:

  • The location is safe and suitable for drone operations.
  • Any required landowner permissions are obtained before the shoot.
  • All necessary details (location, timings, access, contact persons) are provided in advance.

13. Liability

While every effort is made to conduct drone operations safely and legally, Dan Conway Photography cannot be held liable for restrictions, delays, or cancellations caused by airspace regulations, adverse weather, or safety concerns outside of my control. Liability for damages, losses, or missed opportunities arising from these conditions remains with the client.

14. Force Majeure

Dan Conway Photography will not be held liable for failure to perform obligations if such failure results from circumstances beyond reasonable control, including but not limited to extreme weather, airspace restrictions, equipment failure, illness, strikes, acts of God, or government regulations.

15. Indemnity

The client agrees to indemnify and hold harmless Dan Conway Photography against any claims, damages, or liabilities arising from the client’s misuse of drone footage or failure to comply with this Booking Policy.

16. Privacy & Confidentiality

All client information provided through the booking process is treated as confidential. I do not share personal details with third parties unless required by law or regulatory authorities for the purpose of authorisation applications.

17. Agreement

By commissioning drone services from Dan Conway Photography, the client acknowledges that they have read, understood, and agreed to this Booking Policy in full.
